Victims Of Illegal Foreclosures To Be
Compensated

If you believe that your
foreclosure was illegal, you can now submit a claim and get a review by
an independent company. If errors were found during the review you will be compensated. This
is great news for over four million homeowners who were foreclosed on in 2009 and 2010.

The robo-signing fiasco has raised serious questions about the
foreclosure process. Several
lenders and loan servicers were caught cutting corners, which led to millions of foreclosure
cases being dismissed by judges across the nation.

Earlier this week lenders began mailing millions of letters to
homeowners informing them that
they had to submit claims. The lenders included those who were sanctioned by the Federal
Reserve, the Office of Thrift Supervision and the Office of the Comptroller of the Currency.

The
foreclosure house must be the primary residence of the homeowner. And the reviews will
be looking at six areas of compliance in the foreclosure.

>> If the foreclosure occurred while the homeowner was on active military duty or if it occurred
within 9 months of the homeowner ending active military duty.

>> If mortgage payments or fees were inaccurately calculated.

>> If the foreclosure occurred while the homeowner was still waiting for an answer from the
lender regarding a loan modification.

>> If the foreclosure occurred while the homeowner was under bankruptcy protection.

>> If the foreclosure occurred when the mortgage balance was more than was actually owed.

>> If the foreclosure occurred while the homeowner was complying with the terms of a loan
modification agreement.

In addition to mass mailings to reach potential client, ads will appear in print media. About
70% of the
homeowners are still residing in their homes. The remaining 30% of homeowners
who have moved could miss an opportunity to collect money from the banks. They have until
April 30, 2012 to submit claims for the reviews.

The success of the review program will have an impact on the litigation of the 50 states
against the banks.  A settlement have not been reached yet. If a
lender pays the homeowners
under the review, then the lender can not pay the states in the class action lawsuit. This would
be double payment.
